What cases do we return to over and over again as workplace investigators? Which decisions contain the foundational principles for workplace investigations? Are there cases that are particularly useful for the work that we do?

Join us for a special mid-summer webinar in which Rubin & Co. LLP lawyers share their own favourites and why they are touchstones for those who are involved in conducting or advising on workplace investigations.

Well-established workplace practices can feel routine and effective, making it difficult to recognize when they may be contributing to inequity. Often, it is only after a discrimination complaint is raised that deeper, systemic problems become visible.

This session will explore the critical role of systemic discrimination reviews in fostering fair and inclusive workplaces. Attendees will receive useful tips on how to identify when a review is necessary and how to effectively navigate the legal, organizational, and cultural complexities that often arise. It will also provide practical insights into what to look for during these reviews — highlighting key indicators, patterns, and risk areas that may signal systemic issues. This session is designed for leaders, HR professionals, and advisors.

Being prepared for investigation interviews is essential, but what do you do when something unexpected happens during the interview? Perhaps a complainant is not focused. Maybe a respondent is distracted. A witness might ask that they start the interview by asking you questions. Or something completely out of the ordinary occurs. How do you maintain your composure and ensure the interview is productive and on point? In this webinar, our experienced workplace investigators will discuss their strategies for ensuring that interviews remain productive, even in the face of unexpected challenges.

Some of the most interesting developments in workplace investigations and human rights law never reach a broader Canadian audience because the decisions are published only in French. Which recent Québec cases deserve national attention? What practical lessons can investigators and lawyers draw from them? And what emerging trends are beginning to take shape?

Join Janice Rubin and Frédérick Doucet as they review a selection of noteworthy Québec decisions released between 2024 and 2026. Together, they will examine the facts, findings, and practical implications of these cases, with a focus on issues that matter to workplace investigators, human rights practitioners, and labour and employment lawyers across Canada.

Please note, this webinar will be delivered in English.

Et quelles tendances émergent de la jurisprudence québécoise?

Joignez-vous à Janice Rubin et à Frédérick Doucet pour cette revue de décisions québécoises marquantes rendues entre 2024 et 2026. Assessing credibility is one of the most challenging aspects of conducting workplace investigations. Investigators must be able to clearly articulate in writing why they reached their credibility conclusions, which can be difficult for even the most seasoned practitioners.

As we continue our webinar series at Rubin & Co. LLP, we will focus on practical approaches to addressing some of the most common credibility challenges faced by investigators. Using realistic scenarios known to be difficult, we will examine how to assess evidence, weigh competing versions of events, and make clear credibility findings.
